About these terms
These terms apply when you use the Kind Witness app or this website. They are between you and Blerc Pty Ltd (ABN 55 649 912 461) of Sydney, Australia, called "we" and "us" here. By using Kind Witness, you agree to them.
What Kind Witness is
Kind Witness is a personal diary. It records what you tell it and helps you share it. It is not a medical device, and it does not diagnose, treat, cure, prevent or monitor any condition. It is not for emergencies: in an emergency, call your local emergency number (000 in Australia).
The information on this website is general information, not medical advice. Read our medical disclaimer
Your diary is yours
Everything you record stays yours. It is stored only on your phone, so keeping it safe is in your hands: make backups, and keep your recovery code somewhere safe. We can't see, restore or recover your diary for you.
Kind Witness Pro
Pro is sold through the App Store and Google Play under their terms, and the price is shown in the store before you buy. A subscription renews until you cancel it in your store account, and Pro stays on until the end of the time you've paid for. Refunds are handled by Apple or Google under their policies.
If you stop paying, nothing is taken away. You keep every entry and photo, and you can still add to, read, back up and export your diary. Only the Pro extras switch off.
Using Kind Witness fairly
Please don't misuse the app or this website. Don't try to break into them, copy them to sell, or use them to harm anyone.
Our work
The app, this website, the Kind Witness name and its designs belong to Blerc Pty Ltd. You're welcome to print and share our printable diaries and guides for personal, non-commercial use. Clinicians and patient charities may also print them for their patients and members, free of charge.
Your rights under Australian law
Nothing in these terms takes away rights you have under the Australian Consumer Law, which gives you guarantees that can't be excluded.
As far as the law allows, we aren't responsible for decisions made using what's recorded in Kind Witness, or for a diary lost because it wasn't backed up. Where the law lets us limit our responsibility, it is limited to supplying the service again or refunding what you paid for it.
These terms are governed by the law of New South Wales, Australia.
Changes to these terms
We may update these terms. If a change matters, we'll say so in the app or on this page before it applies.
